Discrimination Based on Pregnancy and Related Conditions

On October 4, 2022, the Department of Education (DoED) released new guidance for students and schools on Title IX’s prohibition of discrimination based on pregnancy and pregnancy-related conditions, including termination. The guidance was released in response to the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization.

This guidance is based on existing Title IX regulations. DoED is currently reviewing comments to a proposed Title IX regulation and anticipates releasing the final rule in March 2024.
