Three days before President Trump’s inauguration, Biden’s team finalized a rule allowing the DOJ to weaponize agency guidance—informal, nonbinding documents—and use them against private businesses, individuals, and even state and local governments.
This move reverses Trump’s first-term protections that stopped federal agencies from treating guidance as law—and remains in effect despite Trump’s latest executive order limiting the use of guidance for enforcement, making Congressional action essential for long-term accountability.
Why It Matters
Guidance is not law. It’s supposed to clarify regulations, not create new ones. Yet, numerous federal agencies under Biden used it to pressure businesses, schools, and state governments into compliance with their ideological agenda—without oversight, transparency, or accountability.
